The Application
Under Section 160(2)(b) of the Companies Act 1990, the Director may seek the disqualification of a person who has been guilty, while a promoter, officer, auditor, receiver, liquidator or examiner of a company of any breach of his duty as such promoter, officer, auditor, receiver, liquidator or examiner. Under Section 160(2)(f)  the Director may also seek the disqualification of a person who has persistently been in default in relation to the relevant requirements.

Outcome:
On the 27th of November 2014, John Francis Liwosz who was a director of Aventine Resources Plc was made the subject of a disqualification order for a period of seven years and Anthony William Browne who was also a director of Aventine Resources Plc was made the subject of a disqualification order for a period of six years.  The court also ordered that the Director recover as against both John Francis Liwosz and John Anthony Brown, his costs of the proceedings, such costs to be taxed in default of agreement. 

The effect of this Order is that John Francis Liwosz and Anthony William Browne are disqualified from being appointed or acting as an auditor, director, or other officer, receiver, liquidator, or examiner or being in anyway whether directly or indirectly concerned or taking part in the promotion, formation or management of any company or society registered under the Industrial Provident Societies Acts 1983 to 1978 for a period of seven years and six years respectively effective from the 27th day of November 2014.
