The defendants were each charged with an offence under section 202 of the Companies Act 1990, which requires the keeping of proper books of account. The charges related to the financial year ending the 31st of December, 2004. 

Outcome: 
On a plea of guilty, the Court convicted the company and Brendan O’Brien of a single offence under section 202 of the Companies Act 1990 in relation to the financial year to 31st of December, 2004, imposed a fine of €100 on each party and directed that they each pay prosecution costs of €200. In the case of Keith O’Brien the Court, having thought the charge proven, proceeded (under Section 1(1) of the Probation of Offenders Act, 1907) to dismiss the charge, subject to the defendant paying prosecution costs of €200.
