Alleged Offence:
The defendant was charged (two charges) with contravention of Section 161(1) of the Companies Act 1990 in acting as a director and secretary of Torque Hydraulics Limited (in liquidation), Company No. 392762, and while subject to a restriction order made by the High Court pursuant to Section 150 of the same Act.

Outcome:
On a plea of guilty, the defendant was convicted, fined €1,000 on each charge and ordered to pay prosecution costs of €1,250, such sum to be paid within a period of four months.
Having been convicted of an offence under Section 161(1) of the Companies Act 1990, the defendant is deemed, pursuant to Section 161(2) of the same Act, to be the subject of a disqualification order for five years from the date of his conviction.
