Enforcement

The Enforcement Unit's primary function is to gather evidence to support the possible initiation of criminal proceedings in cases of suspected breaches of Company Law. This work includes:

  • determining which cases should be initiated;
  • defining the most appropriate proceedings;
  • instructing counsel, preparing case papers;
  • managing case execution and considering appeals.

Principally, the above areas involve the initiation of summary prosecutions at District Court level but may also involve assisting the DPP (Director of Public Prosecutions) where cases have been referred there for decision as to whether prosecutions on indictment should be commenced.

The Enforcement Teams attached to the Unit - whose job it is to examine all cases referred to the Unit for possible prosecution - consist of a mix of administrative staff, legal and accounting professionals, working in conjunction with the members of the Garda Síochána assigned to the ODCE.
