Contravention of Section 202 of the Companies Act 1990, which requires the keeping of proper books of account. The offence is alleged to have taken place on the 19th February 1999. 

Case Dismissed on the basis of the Statutory Defence contained in Section 202 (10)(a) of the Companies Act, 1990 that the Defendants:

"..had reasonable grounds for believing and did believe that a competent and reliable person was charged with the duty of ensuring that those requirements were complied with and was in a position to discharge that duty
