Alleged Offences: 
The defendant was charged with contravention of section 161(1) of the Companies Act 1990 in acting as director and secretary of Heathyside Trading Limited, Company No. 291949, acting as secretary and director of Ashford Downs Management Company Limited, Company Number 398222 and taking part in the formation of Walshes Lough Management Limited, Company Number 432962 while subject to a restriction order made by the High Court pursuant to section 150 of the same Act and failing to abide by the conditions prescribed in the Act for continuing to act as a company secretary and director and for taking part in the formation of a company. 

Outcome: 
On a plea of guilty entered by the defendant, the Court, having thought the case proven proceeded (under section 1 (1) of the Probation of Offenders Act 1907) to dismiss the charges, subject to the defendant making a donation of €2,500 to charity. The court further directed that the defendant pay prosecution costs of €684.
